These terms and conditions relate to the use of Kingsley’s online ordering system. A list of the companies operating this ordering system is attached at Addendum 1.
Placing an order to purchase and pay for Kingsleys product by credit or debit card for collection in the store selected for pickup confirms that you have read and agreed to these terms and conditions.
This service is available to any person who has a credit or debit card in their possession and they have authority to use for the purchase of goods. Kingsleys retains the right to refuse any person for any reason, the right to use this service and you agree that Kingsleys will not be liable for any cost or damages for making this decision to refuse service. If you register using Facebook or Google or open a Kingsleys Account, we will save your order for you to use at any Kingsleys Store to facilitate quick and easy ordering when you visit next.
When placing an order, you will be required to check your order. You hereby agree to check your order and the charges for products selected and any surcharges in the cart prior to payment.
Surcharges may apply for customisation of Burger, Torp, Wrap and for Southern fry pieces that re not set combinations.
We reserve the right to cancel your order if there is incorrect pricing, caused by software error or malicious attack.
WE ARE SORRY BUT WE WILL NOT BE ABLE TO CANCEL AN ORDER if the customised product has already been packed.
If you believe that you are due a refund for any reason, please: 1. If about the product, return the product to the store from which it was received
2. Otherwise, email marketing@kingsleys.com and you will be contacted as soon as possible.
If we are out of stock at the moment you pay for your order, you will be informed on screen.
We do not charge you for using your credit or debit card although we are charged by the bank for the transaction. We do not currently accept American Express or Diners Club cards.
A receipt will be emailed or downloaded to your phone. Where your number is displayed on an “Orders ready for Pickup” screen, please present this receipt. If you do not have your receipt, you will have to provide your EFTPOS payment receipt as evidence that the order you are trying to collect is actually your order.
Only credit card or debit card payments will be accepted, and you undertake not to make any fraudulent use of a card. We do not retain your card details. The only role we play is to act as a secure conduit to a payment gateway. We currently use eWAY and PayPal .
We use reasonable care in providing this service and in using this service, you agree that the maximum liability is a refund of the purchase price of your order.
You indemnify us from any losses or costs or liability we suffer from any acts or omissions on your part that cause us to be in breach of any laws or regulations.
You must not use another person’s details without their permission or carry out any malicious activity or cause any damage to our hardware and/or software.
We expect cardholders to safeguard their cards and ensure that their cards are not misused by anyone else and that if the card is lost, that their issuer and their bank are informed of the loss. Kingsley’s Chicken does not take responsibility for the use of stolen cards and any fraudulent use of customers’ cards and will not entertain any chargeback by card issuers or banks. Customers are welcome to email marketing@kingsleyschicken.com for any help that we may be able to provide, within two weeks of the transaction.
